A Kajiado court has delivered a firm warning to perpetrators of sexual violence against children after sentencing a middle-aged man to life imprisonment for defiling an 11-year-old boy, a crime the court said struck at the very core of a child’s safety and dignity.
The judgment was delivered on January 5 by Principal Magistrate Hon. V. Kachuodho, who found that the prosecution had proved beyond reasonable doubt that the offence was committed in 2022. The court heard that the accused lured the minor to his home under false pretences before subjecting him to sexual abuse.
In her ruling, the magistrate described the offence as heinous and deeply disturbing, noting that crimes of such nature cause lasting physical and psychological harm to children. She ruled that the circumstances of the case warranted the maximum penalty allowed by law.
The minor gave a detailed account of how the accused isolated and threatened him before committing the offence. The prosecution, led by Linda Nzioka, presented five witnesses whose testimonies were found to be consistent, credible, and mutually reinforcing. The court held that the evidence met the required legal threshold for a conviction.
The conviction was anchored on the Sexual Offences Act No. 3 of 2006. Under Section 8 of the Act, any act of penetration involving a person under the age of 18 constitutes defilement, with mandatory sentences determined by the victim’s age. In cases involving children aged 11 years and below, the law prescribes life imprisonment.
The court also relied on Section 124 of the Evidence Act, which allows convictions based solely on a child’s testimony if the court is satisfied of its truthfulness, as well as the Children Act of 2021, which guides child-friendly trial procedures.
