The High Court has confirmed the impeachment of former Deputy President Rigathi Gachagua after dismissing multiple petitions that sought to overturn Parliament’s decision to remove him from office.
In a ruling issued on Monday, June 8, 2026, a three-judge bench made up of Justices Eric Ogolla, Anthony Murima, and Fridah Mugambi found that the impeachment process was conducted in accordance with the Constitution and relevant laws.
The judges held that Parliament lawfully exercised its mandate during the proceedings and rejected arguments that the process was flawed. They also ruled that adequate public participation had taken place before the impeachment was considered and approved.
On the question of the two-thirds gender principle, the court stated that Parliament’s failure to fully achieve the constitutional threshold did not invalidate its legislative powers or prevent it from carrying out impeachment proceedings. The bench noted that the issue could not be used to challenge the legality of the process.
The court further upheld the Standing Orders used by both the National Assembly and the Senate, finding that the procedures followed during Gachagua’s impeachment were legally sound and consistent with parliamentary rules.
With the petitions dismissed, the judgment effectively validates Parliament’s actions and reinforces the Senate’s decision to oust #Gachagua from the country’s second-highest office.
