Political commentator and motivational speaker Fanya Mambo Kinuthia has taken aim at Prime Cabinet Secretary Musalia Mudavadi, urging him to refrain from commenting on constitutional matters on the grounds that he occupies what he terms an unconstitutional office.
Speaking to journalists on Tuesday, Kinuthia argued that Mudavadi lacks the moral and legal authority to advise the country on constitutional issues, including proposals for a referendum, while serving in a position he claims is not anchored in the Constitution. He faulted Mudavadi for continuing to draw substantial salaries and allowances from the public purse despite what he described as the unlawful nature of the office of Prime Cabinet Secretary.
According to Kinuthia, Mudavadi recently suggested that Kenya may require a referendum to address emerging governance and constitutional challenges. However, he dismissed the remarks, insisting that Mudavadi is in no position to champion constitutional reforms.
“The position he holds today is unlawful, so how can he turn around and tell Kenyans that we need a referendum?” Kinuthia posed. “In fact, what Mudavadi should be doing is refunding taxpayers all the money he has received while serving as Prime Cabinet Secretary.”
Kinuthia further challenged Mudavadi to issue a public apology before engaging in what he described as weighty national conversations on the Constitution. He maintained that any discussion on constitutional amendments or a possible referendum should be led by leaders whose offices are clearly provided for in law and whose conduct upholds constitutional integrity.
Mudavadi has in recent days spoken in favour of a possible referendum, arguing that it could provide a structured and democratic way for Kenyans to resolve outstanding constitutional and governance questions.
